By accessing or using Tire Manager Pro ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including business owners, managers, and employees of tire shops and auto service centers.

2. Description of Service

Tire Manager Pro is a cloud-based inventory management platform designed for tire shops and auto service centers. Our Service includes:

  • Tire inventory tracking and management
  • Customer relationship management (CRM)
  • Point of sale (POS) transaction processing
  • Vehicle service history tracking
  • Reporting and analytics
  • Mobile access via progressive web app (PWA)

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that violate these Terms or for any reason at our discretion.

4. Subscription and Payment

4.1 Subscription Plans

The Service is offered on a subscription basis. Different plans may be available with varying features and pricing. Current pricing and plan details are available on our website.

4.2 Payment Terms

  • Subscription fees are billed in advance on a monthly or annual basis
  • All payments are non-refundable except as required by law
  • You authorize us to charge your payment method for recurring fees
  • Failure to pay may result in suspension or termination of service

4.3 Price Changes

We reserve the right to modify pricing with 30 days' notice. Continued use of the Service after price changes constitutes acceptance of the new pricing.

5. Acceptable Use

  • Upload or transmit viruses, malware, or malicious code
  • Attempt to gain unauthorized access to the Service or other systems

By uploading Your Data, you grant us a limited license to use, store, process, and display Your Data solely to provide and improve the Service.

6.3 Data Backup

While we maintain regular backups, you are responsible for maintaining your own backups of Your Data. We are not liable for any loss of data.

7. Intellectual Property

The Service and its original content (excluding Your Data), features, and functionality are owned by Tire Manager Pro and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

8. Third-Party Services

The Service may integrate with third-party services including:

  • Payment processors (Stripe)
  • Authentication services (Clerk)
  • Analytics providers
  • Cloud infrastructure providers

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (with advance notice when possible)
  • Emergency maintenance or security updates
  • Factors beyond our control (internet outages, natural disasters)

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, secure, or continuously available. You use the Service at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIRE MANAGER PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Tire Manager Pro, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

13. Termination

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • Your access will continue until the end of your current billing period
  • No refunds will be issued for partial periods
  • You may export Your Data before your access ends
  • We may retain Your Data for a reasonable period for legal compliance

We may terminate or suspend your account immediately for violations of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in the United States.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
